SUMMARY:

Some twit calls on a random cell phone claiming to be Army CID about an incident that never happened.  I have a certain amount of public presence, so I assume it's likely some sort of scam, but I offer minimal info.

I file a police report and contact my attorney.

Twit calls back, shocked and upset that I called real police.

I ID and email his alleged boss, who SENDS ME A CASE NUMBER and says it's real.

I contact the IG who tells them to cut the shit and drop the case.

I sign a release, my attorney FOI requests a copy of the investigation.

The Army emails him/me a copy of the investigation that IDENTIFIES ME AS THE SUBJECT.

Said "investigation" has gaping errors about me and my service time.

I contact them back to make sure they have my info correct so they don’t do this again, and to point out their incompetence.

Multiple offices insist I was never the subject of an investigation that I have a copy of with my name identified as subject.

Army Reserve Staff Judge Advocate office completely ignores my attorney’s request for charges on a false report.

I’ve tried really hard to just not mention my ex wife. There’s nothing to be gained by living in the past, it’s hard on the children who’ll never know who’s being honest or biased (I can tell you that from my parents’ divorce), and it makes one look like a dick. Well, those kids are now adults, and I need this on file for my own safety.

Gail L. Sanders, my ex wife from a decade ago, falsely accused me of sexual assault.  But wait, there’s more! She made this accusation to ARMY RESERVE COMMAND, and got Criminal Investigation Division involved.

She moved out of the house in 2014, divorce was final in 2016, and I got custody of the kids.  Our only interaction after that was her picking them up for visitation, and they’re long since adults. I sometimes see her across the room at a comic convention, since I’m a guest/vendor, and she sometimes helps other people set up. I haven’t been alone with her anywhere and won’t risk it, even before this insanity. More on that later.

Part One is that Army CID would have zero jurisdiction over such a complaint because I’m not in the Army, employed by, reporting to, involved in any way with the Army, haven’t been on an Army installation in years, and utterly not responsible to them. And unless Ms Sanders was in drill status or on orders, it still wouldn’t be a military matter, it should be reported to local authorities.

So, when some asshole calls up from a random AT&T phone number in Madison, WI, accuses me of sexual assault on my ex wife, and claims to be Army CID at Fort McCoy, you can guess why I was neither impressed, nor willing to “come and talk about it” with him. He “Had no information” about the incident he was allegedly investigating, and did not furnish any kind of contact or a case number. I told him I’d contact my attorney and the local police, the end.

And I did. I filed a report about some randotard claiming to be CID and a potential threat from my ex wife. Concern resolved as far as I cared.

So several weeks later he calls back, asked if I’ve had a chance to talk to my attorney, and would I like to come in and talk about it?

See above that:

You’re a random idiot on a cell phone.

You’ve furnished no evidence you’re actually CID. No ID, no case number, nothing.

You’re referencing an event that never happened, that

Wouldn’t be in your purview anyway. So fuck off, scammer. I’m not driving TEN HOURS to Fort McCoy, WI, to “Talk about” anything. I don’t want beat up, robbed, or to be in a bathtub full of ice missing my kidneys.

He continued to talk, and was surprised and upset that, “You contacted your local police about me!”

Yes. As I said I would. And I’m about to again.

So I emailed the CID department head and reported this probable scammer or threat. (What happens if I do drive to WI? Do I get beat up for money and ID? Do I get slammed into a stockade with no phone call?)

I got an email back from the CID Idiot in Chief, snide and condescending that of course this was a real investigation, and this is “routine” to not actually prove who they are. Also that they would have arranged to talk locally if I’d actually agreed (Odd that they didn’t offer that, which would have made it a slightly less unlikely scenario).

Now: My wife is actually an investigator for a major defense contractor. CLARIFICATION: She is THE lead investigator for IT security.  She does investigations all day long.

I’ve been interviewed for my security clearances, other peoples’ security clearances, military events I was witness to, etc.

A friend is a senior investigator for DFAS.

So, I actually know how an investigation proceeds.

Sure, you might make a discreet call to make contact. Once established that you’re investigating something, you must then:

Furnish ID of who you are. Or, a case number that can be referenced, not hang up and call back a few weeks later.

A reason for the interview—orders, report, something.

Confirm the ID of the interviewee—do you actually have the right person.

State the information you are inquiring about.

Provide a copy, or a case number for reference.

But even then…

We’re about five steps past the part where they should have:

A: Done a simple websearch, found out I’m a low-level celebrity, and probably get spam calls, scam calls, harassment calls and occasional death threats, so failing to identify oneself would get one tossed into that category. In fact, last month someone called up claiming to be my bank, identified a fraudulent transaction (that they had made), and wanted me to “verify my phone.”  So no, I’m not likely to believe a randotard is a real investigator, especially regarding an incident that never happened over which he’d have no jurisdiction. And

2) Checked my military records, saw they were clean, that I retired 14 years ago, and that I’m smarter than they are. Now, I don’t actually know what these idiots’ ASVAB scores were, but having dealt with thousands of military personnel (and some Army pukes), I’m putting their QTs in the 50-70 range, maybe as high as 80 if they’re just lazy rather than actually all that stupid (I found out later they were stupid AND lazy, so definitely not 80).  But they should have seen the part where I got a PERFECT ASVAB score. Not just 99%ile, but literally every fucking question in every fucking category, including Coding Speed and Accuracy, where they took points off for wrong answers because accuracy is more important than speed, but fuck you, I did both. That should be a hint that the approach they use on Private Fitzquandez who is selling drugs or stealing Army tools isn’t going to work on me. Sure, you might make your first approach clandestinely to see if you get lucky, but after that, assume you’re dealing with someone smarter than you are, because you are. Assuming, of course, you have the mental capability to envision someone smarter than you, which they apparently do not.

I’d like to note my insurance company did this level of due diligence regarding my life insurance. Somehow, “Rock climbing” wound up on my website, even though I am not a rock climber. I had to respond to a lengthy questionnaire about my rock climbing stats, experience, training, and note in every block it was an error and I do not participate in that sport. But check my background? That’s beneath CID.

Full disclosure: A command friend advises me the USAF will not share personnel info with the Army because of the massive risk of it being compromised, see more below.  But even if they’d asked and been refused, a non-idiot would have quickly concluded I wasn’t falling for their bullshit and tried a legitimate approach. And, they had my Army records, which end in 2007.

“You called the [real] cops on us!” Damn straight, dumbass. That should also have been a hint that failing to identify yourself isn’t a brilliantly clever move.  But guess what? That statement I made to my police? That’s now available for you to use for your investigation! You actually have a sworn statement from me. And guess what? IT SAYS EXACTLY WHAT I FUCKING TOLD YOU.

I’m going to keep calling them idiots because they are. “Hurr, hurr, we’re so clever we don’t identify ourselves, so why are you questioning us? We’re seekrit! And clever! We told you we were CID!”

My immediate horror here was that THESE SHIT FOR BRAINS DON’T SEE A PROBLEM that if someone calls up and says they’re CID, no documentation provided, apparently most of the Army will just start telling them things. Now, here’s a scenario for you:

Civilian cell phone: “Hi, I’m with CID. You’re not in trouble, we’re trying to trace something you might have information to help with.”

PVT Snuffy: “Oh, yes, sir!”

Phone: “First, can you send me a photo of your military ID so I can confirm you’re actually who you say you are?”

Snuffy: “Sure! Here!”

“Thank you. Now, Sgt Smith isn’t in trouble, but he may have made contact with someone we’re interested in. Can you confirm Sgt Smith’s duty section and hours? Thank you. And he’s there today? Great. Was he gone at any point recently? Okay, cool.  So, everything’s fine with him, but please don’t mention this to him or anyone. Now, is anyone deployed at the moment? And where?” Etc

Sure, the Chinese are going to get all this info eventually, but you don’t make it fucking easy for them.

My wife the security professional had a twitching eye during this phone call. On the one hand, idiots like this are why she stays employed. On the other hand, they’re why she stays employed.

Even retired I have an obligation to report this, and did, to a friend in USAF intelligence. A general.  I figured he might know already, but wanted due diligence on a massive fucking security risk.

In short: “Oh, everyone knows the Army is worthless for OPSEC and COMSEC, we just don’t tell them anything we don’t have to. CID are not only incompetent, they have no grasp of civil rights or procedure. Half the stuff they bring to us is tainted or compromised. No, we wouldn’t share your military records with them anyway without them getting a DoD order. And if you actually went to talk to them, even odds they’d illegally detain you.”

A retired (a while back, not the current shitshow) Army colonel JAG officer mirrored that latter sentiment.

So, that’s what the real military thinks of CID.

A dispatcher in a major metropolitan area told me they refuse to hire former CID because they have “too many bad habits.”

These idiots are at Fort McCoy (“Fort McCow”), Wisconsin, which is not exactly a posting for the best and brightest. Either the boss is pending retirement and likes the rural area, or they stuck him there to minimize the damage he can do even with their shoddy standards.

Note that they’d done enough research to have my phone number, which should have given them all the other basics—Not in the Army, separated a decade, divorced eight years, remarried, etc.

I filed an IG complaint and they were told forthwith to terminate “investigating” me. So even their cadre think these two are fuckups by those loose standards. But, the IG did insist that random calls with no ID and no OPSEC are “normal procedure.”  Impressive.

It appears they suffer from a combination of laziness, mental retardation, and institutional narcissism that they’re big damned heroes saving the world, fuck procedures, chain of evidence, civil rights, and basic common sense. And of course, closing cases any way they can, even if they fuck it up, because they can score it as a win even if it’s a loss.

And now I just got the FOI request I submitted via my attorney, which required that I sign a release, even though it’s FOI of an official government process, and I’m a named party.

Summary: She apparently had the usual annual SHARP briefing, wailed a “me too!” that her ex husband assaulted her, but she didn’t want to give details because the “PTSD was so painful.”

IOW, making excuses for why she’ll retire as an E4.

Her unit did a mandatory report and I will not blame them for that. Once they started the paperwork they were stuck. She immediately started walking back that, well, she didn’t want to file a report, wah wah PTSD, and oh, it was before she enlisted in 2004 (so, not her “ex” husband), but somehow everything had been fine until she left me a decade later.  Note that with that statement, she can’t claim it as service-connected for a benefit scam, either.

So, an alleged event before she was in the Army, while I was not in the Army, ergo, should as noted have been “forward to local authorities, not our concern.”

So, before 2004, the timeframe I was involved with the Army at all while involved with her was in the Army National Guard, 1991-1994, and I would have had to be in a duty status (drill weekend) for the Army to be involved. Thirty, 3-0 years ago, and we weren’t even married for half of that timeframe.

Special Agent Seth Wolf is apparently so fucking incompetent he reports me as “Active Duty Army, Aug 1985-Feb 1990.” I was USAF, thank you very much. He then reports that I was in Army Reserve Control Group from then until May 1990. No, I had no connection with the military in that timeframe, it was a break in service. After that, whoever did the redacted tags confused my then wife and my current wife and used the same tag. These blithering idiots can’t even read their own records. There is literally no one involved from either agency who shows functional literacy or intellect.

Also, they redacted my info, her info, their info, everybody’s info, but then put my name and address in with “Subject was identified as,” MULTIPLE TIMES and note again, had the same ref tags for both ex wife and current wife despite them having completely different first and last names (neither changed name on marrying). They identified my lawyer as working in “South Bend, Indianapolis,” which means they don’t even know what state this is. They took the actual street mailing address my attorney provided, his office PO Box, and the state postal code, and turned it in to the mess they have on file as his "address."

 Literally nothing was done correctly.  Both agencies (CID and the FOI Office) are Dunning-Kruger Club, on subjects they are supposed to handle daily.

IT STILL GETS MORE INSANE: when I contacted all parties to correct that I was never active duty in the Army, “Special Investigator in Charge” David Bertram emailed back to tell me I was never a subject of that investigation number that he furnished to me, which investigation has my name on it as SUBJECT. I forwarded his own email back to him and he did the first correct thing so far and went silent. His bosses at CID IG kept insisting that Bertram had told me I wasn’t investigated, so that was it.  Except of course I have the documentation of them telling him to end the investigation, and the FOI copy of the 20 page investigation report. So either he can’t even keep a record of his investigations, or there was some sort of fuckery at his end to try to make the matter go away. Apparently, it was word games because I wasn’t “vested” as a subject if they continued the investigation, but he fucking well knew what I meant.

My wife, the IT forensics expert with a security clearance and previous DoD experience says she’d be happy to look through his system for those files if he can’t find them, and any others he might have lost. And who knows what else he has on his government computer?

I certainly wouldn’t hire this clown to look for a lost marble in a toy box.

Then, their IG kept insisting if I wanted to “correct my records” I had to “contact my chain of command.”

I’m retired USAF. My chain of command is Air Reserve Personnel Center, who has the data correct (though I’m going to double check the Army didn’t somehow fuck that up). YOUR chain of command has things fucked up, and YOU need to fix it.  I don’t want further investigations referencing that one to try to pollute me with any Army retardation.

So, under advice of attorney and senior officer friend, I contacted my Senator.

The Army responded with “All we can do is send a letter stating you weren’t in the Army.”

Well, that’s certainly a start, but I need to know how you came to that conclusion in the first place, then I need you to fix it, then I need you to correct your official report, because any of that might affect my actual service record, pension, VA benefits, etc.  But they don’t know how to do that.

I’m going to point out that “Special” Agent Seth Wolf’s sworn statement about me is erroneous, and he has refused to fix the error, therefore, he knowingly has a FALSE SWORN STATEMENT, violation of Article 107 of the UCMJ. This is fine, apparently.

Also, my ex belongs to 318th Press Camp Headquarters, a public affairs unit, who apparently don’t see a problem with one of their “soldiers” making a false sworn statement, Art 107, about a non-Army person, tying up resources and lawyers and reflecting badly on the same Army they’re supposed to represent officially.

Nor is the Staff Judge Advocate office going to file charges for a false report to at least get a letter of reprimand on file.  This is fine.

This is the depths the US Army has sunk to.

On 13 May, 2024 at 1638 [all times EDT], I received a phone call from 608-377-1604, a civilian cell number showing as provided by AT&T, Tomah, Wisconsin.  I did not catch the respondent’s name. He stated he was an investigator with Army CID at Fort McCoy, investigating a claim of sexual assault by Gail Sanders, and could I assist. I asked who was the alleged subject, and he said it was me.

I have not been in private with Ms Sanders since 2014, and have had very little public contact, always in the presence of others. There has been no physical contact, not even a handshake, and no assault.  I explained there was no way any such assault could take place. I asked for specifics—time, location—he said they had no details. He asked if I would “come in and talk to them about it.” I stated I would consult with my attorney, and would not. Note that Fort McCoy is a 10 hour drive from here. He did not mention any local office, though I know they have a presence at Fort Harrison and Camp Atterbury.

CONCERNS: CID would not have jurisdiction over such a complaint unless she was on duty at the time (as a reservist), or the incident took place on military property. Additionally, the Army CID district for this area is out of Fort Campbell, KY.

Such a complaint is completely out of left field, had no supporting details, and came from an unusual location via a civilian number. It’s certainly feasible an investigator would use a civilian number for discretion. However, as noted above, they would have no jurisdiction over a non-military incident, which should have been reported to local police.

This may have been entirely an attempt at a scam. 

However, Ms Sanders’ previous behavior does include stalking individuals, including military members.  I do have supporting evidence, but I prefer to keep it discreet for those individuals’ privacy and safety. I can show it, but prefer it not be public record. In at least one case (2012) she stalked a male superior and his civilian wife with false online identities and harassed the wife at length, and brought me copies of her printouts which I retain with the victim’s knowledge. They are datestamped from her military computer. This was reported to the IG at the time.

It is likely she did file a report of sexual assault. I believe it is entirely possible Ms Sanders will attempt to provoke additional police response in the local area.

I would like to note I have an exceptionally clean record, without even a traffic citation in the last 16 years. I am a nationally best-selling author with a visible public presence. My wife Jessica Schlenker works for [DEFENSE CONTRACTOR] as manager of the Security Operations Center and the Lead IT Forensics Investigator.  She is allergic to pot. We have no affiliations with any questionable groups, no violent tendencies, and will be happy to respond to any concerns 24/7 at our contact below. Email to Ft McCoy CID office, 4 June, 2024.

Per the advice of my attorney:

I need to file a report and complaint on an individual claiming to work for CID, who may actually be an impersonator. If not, his actions are unprofessional and require attention.

I may also need to file charges against SPC Sanders, Gail L, SSAN REDACTED for filing a false complaint.

Per the attached document, furnished to my local police department, this individual contacted me from a private cell number, claiming to be a CID investigator. The events at my end are as I describe.  I did consult with my attorney, and filed the police report with [local] Police.

Today, 4 June 2024, this individual called back from the same civilian phone number at 1451 EST. He asked if I’d talked to my attorney and asked again if I wished to “Come in and talk to him.”

I advised him that my attorney had advised me to file the police report, and not to talk to him. I summarized as in the police report that I was a ten hour drive away, had no private contact with the accuser in over a decade, and that CID wouldn’t have any jurisdiction unless this was on a military location or duty status.  I asked once again for either an incident report number, date and time, or other information about the allegation, and he again said he “didn’t have any information.” He did state that his office has jurisdiction over her Reserve unit, which I believe is in the Chicago area. I have never visited it in any fashion, do not know the unit name, or other information, because I make a point of not contacting my ex wife.

He did note that my local PD had contacted him, and he sounded both surprised and concerned about it, even though I had advised I intended to do so. As that report is relevant to any such investigation, it’s concerning to me that this individual was upset about it. Additionally, he offered no information about his ID, an office number or chain of command contact, or other bona fides. He’s just some guy with a cell phone claiming to be CID about a complaint with no details.

I advised that if there was no incident number, date or time or other details, there was no information I could give and would not discuss it further. I regard these circumstances as unprofessional and harassment. If CID has a legitimate concern, they should contact me from an official phone number, send a letter, or have a local investigator ask to meet with me, not call from a civilian AT&T phone in Madison, WI and ask me to talk about an incident they can’t articulate.  If that is what is happening, I am filing a complaint of harassment against this officer.

I also asked that based on the harassment, I wanted to file a charge of false complaint against SPC Gail Sanders. He stated he did not have the power to do that.  My attorney informs me that per his knowledge, CID absolutely has the ability to file such a charge.

If it turns out this individual is not actually a CID officer, you obviously have your own procedures for addressing it. If so, I’d like to know it’s an impersonator so I can keep my local police up to date.

If there is a complaint from SPC Gail Sanders, then I will state it is false. I have had no private contact with her since she moved out in Nov 2014, and only the briefest of public contact when she picked up the children for her weekly visitation (I had primary custody of the children), and even less since they reached adulthood. I would not enter her house under any circumstances based on our separation, and the disgusting state of the place. If such a false complaint exists, I wish to file a countercharge of a false report. Please advise on information you need for this.

Good afternoon. I am the Supervisory Special Agent in charge of the Fort McCoy CID Office. I have read through your email and the attached word document. Firstly, Special Agent Seth Wolf does, indeed, work for me and is assigned to as a Special Agent to the Fort McCoy CID Office.

You were contacted by Special Agent Wolf, at my direction, as part of our investigation. You related you wanted to consult your legal counsel prior to determining whether or not to be interviewed by CID, as is fully within your rights. Special Agent Wolf contacted you earlier this week, again at my direction, to determine if you had consulted with legal counsel and whether or not your are willing to be interviewed. I can assure you this is a routine practice during the course of an investigation and, as such, do not constitute any type of harassment. You expressed in your email that you have been advised by your attorney not to consent to an interview. If you could please provide contact information for your attorney, we will contact them going forward should we need to reach out to you.

With regard to your additional concerns regarding your contact with Special Agent Wolf, we do not disclose information concerning on-going investigations to individuals involved in the investigation. However, I can provide the case number. 00050-2024-CID065-009602. Any additional information concerning the case will require a FOIA request to United States Army Crime Records Center (USACRC) after the conclusion of the investigation. Additionally, our personnel are issued cell phones for official use in completing their investigations. Therefore, it is routine practice for our agents to call and schedule interviews and make coordinations via their government issued cell phone. If you had agreed to an interview, an agent from the closest CID office to you, in this case it would likely be the Fort Knox CID Office, would have coordinated with your attorney to travel to you for interview. You would not have had to travel to Fort McCoy.

Pertaining to you desire to file a complaint for False Reporting by SPC Sanders, our office makes the determination, through the investigative process, as to whether or not the is evidence to support that a report is false. At this time, Army CID will not be initiating an investigation concerning SPC Sanders falsely reporting an incident. Further, Army CID does not “file charges”. That responsibility rests firmly with the Office of the Staff Judge Advocate.

SUMMARY OF IG COMPLAINT:

Please read the attached documentation for background. [I sent all the related documents with the complaint.]

COMPLAINT:

For the record, for the fifth time: I have had no physical contact with my ex wife since 2014. I have had only the most minimal of public contacts, predominantly regarding her visitation of the minor children as I was primary custodial parent. Since 2019 (when my son graduated high school), such contact is even less frequent, and largely pleasantries in passing.  I do not contact her and do not wish any contact with her in any fashion.

I have confirmed with my attorney; a colonel commanding; a retired JAG officer and War College instructor:  If she was not in a duty status or I was not on post, CID has no jurisdiction over such a complaint. Therefore, for them even to contact me is improper and it should be referred to the appropriate civilian agency. If said complaint alleges either of the above, they should be easy to verify and furnish date, time, and location. I assume even CID officers can manage a SALUTE report. [APPARENTLY I WAS GIVING THEM TOO MUCH CREDIT EVEN WITH THAT---MIKE]

The followup call had the same complete lack of documentation as the first, asking the same vague questions, and the agent sounded surprised that I’d contacted my police department, when I’d specifically stated an intent to do so.

My wife is an investigator (specifically, the lead IT forensics investigator for [DEFENSE CONTRACTOR], as well as manager of the security operations center). I have worked with numerous investigators including for background checks for clearances (mine and others).  The procedure I’m familiar with is:

Investigator makes contact, introduces themselves.

Furnishes bona fides—a badge, card, landline or website with contact information, and an ID number or case number.

States the purpose of the interview, furnishes specifics on the information they seek.

It should be very simple to understand that an unknown party on an unknown cell line claiming to be CID but furnishing no specifics is absolutely a potential security risk. A quick online search will show that I’m a low-grade celebrity with a public presence, and I have had previous harassment, death threats, and other issues.

Nevertheless, I gave relevant information that would not endanger my safety. While the senior investigator finally admitted in the later email that a local interview could be arranged, the repeated requests were that I “come talk to me,” at Fort McCoy.

This behavior is grossly unprofessional. If that IS “routine” for CID, it is substandard to the industry I’m familiar with. This should be addressed. If it is not routine, the personnel need counseled to behave professionally, and be aware of their jurisdiction.

Additionally, repeatedly asking the same intrusive questions but without articulating details becomes harassment.  If they have a credible line of query, they can send a letter, send an agent, send an email, furnish some sort of documentation, and then we can discuss that I will give them exactly the same information they already have at least five times at this point. That is the entirety of the information I will furnish on this matter.

They still have not established a valid reason for them to have jurisdiction.
